In relation to the death of Kelvin Lashawn Baker, who passed away while in police custody last year, Attorney General Anthony Brown declared that his office will not press charges.
According to officials, the 46-year-old was handcuffed and loaded into the back of a Washington County police car as officers prepared to carry out a search warrant at his Hagerstown residence.
Investigators said that when Hagerstown Police Department officers carried out the search warrant at a residence in the 100 block of East Washington Street at around 10:15 p.m. on October 26, 2024, they saw Baker outdoors with another woman.
According to officials, he started vomiting while in the backseat of the police car, had trouble breathing, and lost consciousness. After being taken to a nearby hospital, Baker was declared dead.

Officers can be seen speaking with Baker for a little while before handcuffing him and putting him in the car in the footage that was made public on Thursday, March 6.
Something transpired during the next forty-five minutes, and although officers tried to rouse Baker, they could hear him gasping for air and making strange noises.
After his shackles were taken off, paramedics put him on a stretcher. The cause of the medical emergency is still unknown.
“After completing its investigation and evaluating all the available evidence, the Office of the Attorney General has determined that the subject officers did not commit a crime under Maryland law,” officials stated.
“Accordingly, the Attorney General has declined to prosecute any of the officers in this case.”
